TERMS OF USE

Please note that the public terms below also apply to all users of this site. Membership Terms are specific for CANVAC Members only.  By using this website, you agree to the following terms applicable to you:

PUBLIC TERMS

 

The Canadian Network for Visual Analytics ("CANVAC") provides access and use of the CANVAC website at www.canvac.org ("Site"), subject to your agreement to the following "Terms of Use" (the "Terms"). Please read these Terms carefully before accessing or using the Site. By accessing or using the Site, you agree to be bound by these Terms, which are as follows: 


1.      The content of the pages of the Site is for your general information and use only. It is subject to change without notice. 
2.      Neither CANVAC nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on the Site for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and CANVAC expressly excludes liability for any such inaccuracies or errors to the fullest extent permitted by law. 
3.      Your use of any information or materials on the Site is entirely at your own risk, for which CANVAC shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through this Site meet your specific requirements. a
4.      This Site contains material which is owned by or licensed to CANVAC. This material includes, but is not limited to, the design, layout, look, appearance and graphics. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these terms and conditions. 
5.      All trademarks reproduced in this Site, which are not the property of, or licensed to the operator, are acknowledged on the Site. 
6.      Unauthorized use of this Site may give to a claim for damages and/or be a criminal offence. 
7.      From time to time this Site may also include links to other websites. These links are provided for your convenience to provide further information. They do not signify that CANVAC endorses the website(s). CANVAC has no responsibility for the content of the linked website(s). 
8.      You may not create a link to this Site from another website or document without CANVAC’s prior written consent. 
9.      Your use of this Site and any dispute arising out of such use of the Site is subject to the laws of Vancouver, BC, Canada.

 

Privacy Policy

CANVAC is committed to respecting the privacy of online visitors and pledges its best efforts to that end. In general, you can visit the Site on the Web without telling us who you are or revealing anything about yourself. 
CANVAC’s web server automatically recognizes each visitor's domain name, but does not automatically collect personally identifiable information. 
A "cookie" is a small piece of data stored on your computer's hard drive when you visit the Site. CANVAC uses cookies to analyze the Site's overall traffic patterns and improve Site visitors' online experience. CANVAC does not use cookies to store or collect any personal information. Many browsers provide an option to block or remove cookies. You can visit the Site successfully while blocking cookies, but leaving cookies enabled in your browser will help CANVAC to improve the Site's usability and effectiveness. 
In order to provide a more comprehensive and useful site, the Site contains links to other Web sites. CANVAC is not responsible for the privacy practices of these sites. 

MEMBERSHIP TERMS

1. General Terms

These conditions represent an agreement between you and CANVAC. By accepting the agreement you are promising and agreeing also to follow and accept the other rules which CANVAC publishes on its website. This agreement also applies when you purchase products on CANVAC's website; see below under “Terms of sale.” If you don't accept this agreement, you should not register as a member on CANVAC. It is very important that you go through the conditions in this agreement together with your members so that you know what you can and cannot do on the CANVAC website. Ask your members to go through the conditions with you carefully and to help you register. When you register, activate your account and accept this agreement, you become a member. This means that you accept the conditions below and that you confirm that your members have also read and accepted the conditions.

CANVAC reserves the right to make changes to these membership terms if CANVAC deems it necessary or if it is required by law. In the case of material change, CANVAC will notify you of the change in advance of the change becoming effective. If you do not want to accept the change, you may terminate your membership with immediate effect at any time before the change becomes effective. You can easily terminate your membership here. By using the services available on CANVAC’s website, such as Star-dollars and virtual products (virtual clothes and all other goods and services on CANVAC's website) you accept the membership terms and agree to comply with them.

CANVAC solely decides on the content of the CANVAC website, such as for example new games, products, including the rules of such games and products. CANVAC further reserves its right to develop, delete, amend and otherwise make changes to the website without any prior notice to you or other members. Your membership, me-doll, virtual products and CANVAC are part of a service provided to you on CANVAC’s website and you only receive a right to use them according to these conditions and the terms on the website from time to time.

2. Special information for MEMBERS

CANVAC is dedicated to protecting the privacy of its members and handling any personal information we obtain from our members with care and respect. The information and the terms in this agreement that we conclude with our members fulfils the high standard of protection provided for in Canada under the Pesonal Information Protection and Electronic Documents Act (PIPEDA) . From the terms on Personal Data and Privacy Policy below you can see what information we collect from our members, what we do with it and the limited involvement of third parties. An overall principle is that we do not collect more information than is reasonably necessary for member to participate in activities on CANVAC.

For the security of our members CANVAC retains the right to require the identification of members. CANVAC can only disclose personal data belonging to member other than your own if a legal and/or police obligation exists to do so.

3. Personal data and Privacy Policy

In order to register and participate as a member of CANVAC, we might ask you to provide us with the following personal data:

- Your first and last name,
- your e-mail, instant messaging address,
- member e-mail address
- your mobile phone number
- your user name,
- your age,
- your gender,
- the country where you live
. your home telephone number

By providing CANVAC with personal data as defined above, to the extent permitted by law, you give CANVAC permission to use the above personal data so that CANVAC can send out news, contests, offers and advertising to your e-mail address and/or mobile phone via sms, mms or similar messaging system, and you allow CANVAC to adjust the content and advertising on its website to your or others' age group and gender. Examples of communication are, for instance, promotional newsletter e-mails, to notify you about new or improved services on CANVAC, that CANVAC is carrying out membership surveys in order to improve our services or that CANVAC is creating targeted content and offers for you based on information about how you act on the Web site, what your age is and where you are located geographically. You may opt-out from the CANVAC e-mail program at any time, either by following unsubscribe links within received e-mails, or by adjusting your CANVAC email settings.

CANVAC agrees not to sell or transfer your personal data, including e-mail addresses, to a third party. An exception is if all or essentially all resources of the CANVAC company, that is to say, the entire website, are acquired by another company (a so-called acquisition of assets and liabilities). In that case the personal data required in order to continue to operate CANVAC are acquired by the buyer.

It can happen that CANVAC comes to rely on other companies in order to carry out various tasks such as, for example, help with marketing, the performing of technical services for our websites, etc. These companies can in certain cases gain access to personal data which they need in order to complete an assignment for CANVAC. CANVAC treats all personal data with the greatest care and signs agreements with other companies which mean that they can only use your data in order to complete the assignment for CANVAC.

The same applies in those cases where CANVAC co-operates with another company to provide you with interesting offers. Such companies do not have access to your personal data other than for assisting CANVAC with its mailings, banner marketing and the like which you have given CANVAC permission to by this agreement. Such companies will not have the right to retain and use the data for any other purposes than the assignment for CANVAC.

CANVAC stores personal data gathered from members for such period as is prescribed by applicable law. During this period personal data are only used to the extent permitted by these terms and by applicable law as well as for the security of members, that is, in order to prevent, investigate, uncover and prosecute potential crimes against one of our members. CANVAC reserves the right to disclose your personal data as required by law and when we believe that disclosure is necessary to protect our rights and/or to comply with a judicial proceeding, court order, or legal process served on our site.

CANVAC reserves the right to modify this Privacy Policy at any time, so please review it frequently. If we make material changes to this policy, we will notify you here at this URL, by means of a notice on our home page or as required by law. If any changes are unacceptable to you, you shall stop using this site. Your continuing use of the CANVAC website, can, to the extent permitted by law, be deemed as an acceptance of these terms, including changes.

4. Questions concerning personal data and revoking approval

If you want to know what information CANVAC has about you or have other questions about your personal data, you can contact us here. You can also contact us should you wish that CANVAC  destroy your personal information, by also contacting us here.  Please note that this means that your membership in CANVAC is canceled as a result, see more under clause 10 below.

In order to be able to offer the best possible member experience on CANVAC, we need to be able to store personal information about you (so-called personal data) and to be able to communicate with you as a member.

Therefore, if you do not allow us to process personal data about you, we cannot handle your membership. For this reason we ask you to cancel your membership if you do not wish to allow us to process your personal data.

5. Cookies

CANVAC can place a text file in the web browser on your computer which is called a “cookie.” Like most other websites, CANVAC uses both different types of cookies to improve and customize your experience of the website. With persistent cookies we keep track of, for example, how many visitors we have to the website and of which parts of the website are most popular. This type of information can be sent out by CANVAC in a revised (that is to say, aggregated and non-personal) version as statistics to members, collaborative partners, sponsors and others.

This means that we, or our third party service providers and/or our partners, may use cookies to manage and measure the performance of advertisements displayed on or delivered by or through the website. This also helps us, our service providers and partners to provide more relevant advertising. For more information regarding third-party ad servers, see below "Collection of Information by Third-Party Sites".

You can change your privacy preferences regarding the use of cookies and similar technologies through your browser. You may set your browser to accept all cookies, block certain cookies, require your consent before a cookie is placed in your browser, or block all cookies. Blocking all cookies will affect your online experience and may prevent you from enjoying the full features offered at our website.

5.1. Collection of Information by Third-Party Sites, Ad Servers and Sponsors

The CANVAC website can contain links to other websites, including those of sponsors and advertisers, whose information practices may be different from ours. Sometimes these third party websites might conduct contests or sweepstakes that are promoted on the CANVAC website. Visitors should consult those other third party websites' privacy notices, since those websites are not covered by our Privacy policy and may follow different procedures.

Additionally, CANVAC and our advertisers may use third parties to serve or present the ads that appear on our site and to conduct research about the advertisements. These third parties may view, edit or set their own cookies. We, our third party service providers and/or partners may also place cookies, web beacons, clear .gifs or similar technologies to help present such advertisements, and to help measure and research the advertisements' effectiveness. The use of these technologies by these third parties is subject to their own privacy policies and is not covered by our Privacy policy.

6. Rules of conduct

You must not reveal or trade passwords or reference numbers, change email to scam email addresses, enter password on phishing sites or use proxies or in any other way treat your account, password and other personal information in a careless manner. This may lead to loss of account and/or items and CANVAC members. CANVAC can not be held responsible if your password, reference number, email etc has been used by a third party. CANVAC will do its best to restore lost accounts, provided that you claim of such lost account is sent to CANVAC within 3 months after the loss.

7. Rules and responsibilities for member-generated material

You are responsible for whatever material you create yourself and publish (upload) on to CANVAC's websites, for example, comments, posts, chat sessions and the like. Whoever violates CANVAC's rules of conduct can be expelled as a member; for more about this see below under item 10.

8. Rights to member-generated material

You own the rights to the material which you have created yourself on CANVAC's websites, but in this agreement you give CANVAC the right, without special compensation, to publish the material for an unlimited time throughout the world and irrespective of the medium used, that is, whether on the Internet, on TV or through mobile distribution, etc. This means that you give CANVAC the right to use, copy, present, reproduce, display, edit, integrate, license as well as distribute that material which you have created. These rights of CANVAC apply to both commercial and noncommercial use.

9. Rights to CANVAC's material

You may not use CANVAC's information, data, names, pictures, logotypes or icons from CANVAC's website (we call these “CANVAC's Material”) if it is not clear from the website that this is permitted. This means that you can not copy, distribute, disseminate, sell, publish, send or otherwise circulate CANVAC's Material to another person without the written consent of CANVAC. Nor may you change, revise or replace any of the Material found on the website, either in its entirety or parts thereof.

10. Suspension and cancellation of membership

CANVAC has the right to cancel your membership and close your account if you violate this agreement or the regulations on CANVAC's website or if you have not used your account for four months or more. We can also close your account if you fail to pay for the goods and services that you buy or if you shop without the permission of the person who is paying according to item 16 below.

When your membership is canceled, whatever time remains on your Superstar membership is forfeited and the CANVACars in your account disappear.

CANVAC has the right to save the personal data of a suspended member even after the account has been closed; see item 3 above.

11. Choice-of-law and jurisdiction

Subject to local mandatory law, this agreement is regulated and interpreted according to the laws in Canada and the courts in Vancouver, BC will have exclusive jurisdiction. If any part of this agreement should be considered invalid, this will not affect the validity of the remaining sections of the agreement.

12. LIMITATION OF LIABILITY and DISCLAIMER OF WARRANTY

CANVAC decides solely on the content of the CANVAC website and reserves its right to develop, delete, amend and otherwise make changes to the website without any prior notice to you or other members. Potential errors on CANVAC's websites are taken care of as soon as possible, but CANVAC does not guarantee that CANVAC's websites always work.

Material published on CANVAC's websites can refer to products, programs or services no longer available in certain countries.

You use the CANVAC websites at your own risk. CANVAC does not warrant the accuracy or timeliness of the websites.

All submissions by you or other members are solely the expressions of the sender and CANVAC can not be held responsible or liable for the content in such submissions. All content on the CANVAC websites, including without limitation third party content, submissions and any information or material contained on the websites, are provided to you on an “as is” basis with no warranties of any kind. CANVAC, neither by itself or its licensors, agencies or other representatives, makes no express, implied or statutory representations, warranties or guarantees in connection with the CANVAC websites, including without limitation the CANVAC content and third party content. CANVAC does not provide any warranties against viruses, spyware or malware that may be installed on your computer.

13. Links to third party websites

CANVAC's website may contain links or references to other websites. When you use these links, you are leaving our website. CANVAC has no control over information published on other third party websites and assumes no responsibility for information and other content on such other third party websites. You assume the risk yourself when using other websites linked to this website. We encourage you to review the privacy policy of other websites you visit.
